NRI Property Verification in Karnataka: What Only a Lawyer Can Check

For NRIs buying property in Karnataka — how title is verified remotely through Kaveri and Bhoomi, the FEMA and PoA points that matter, and the risks records alone do not show.

An NRI buying property in Karnataka — a second home in Mysuru, a coastal plot near Mangaluru or Udupi, a flat in Bengaluru, or land in the family's home district — usually cannot inspect the documents in person and is relying on a relative, an agent, or a builder's word. That is exactly the situation in which independent verification matters most. The good news is that Karnataka's records are online, so the title can be checked remotely. The part that needs care is what those records do not show, and the FEMA and power-of-attorney questions that are specific to a non-resident buyer.

What can be verified from the records

The same record sources that serve a resident buyer serve an NRI buyer: the Encumbrance Certificate through Kaveri Online, the RTC and mutation register through Bhoomi for land, e-Swathu Form 9 and Form 11 for gram panchayat property, and the registered title chain. These confirm ownership, the extent, registered encumbrances, and conversion status. Because they are queried remotely, the documents an agent or builder produces can be checked against the official position before any money is sent.

What the records do not show

  • An unregistered family arrangement or an heir who never signed — these never appear in the EC.
  • Whether the person offering the property actually holds authority to sell it, as opposed to merely possessing the documents.
  • Physical possession, encroachment, or whether the boundaries on paper match the ground.
  • Whether a power of attorney relied on in the chain is genuine, in force, and adequately stamped — a recurring weak point in NRI transactions.

How our property document verification works

Under FEMA, an NRI or OCI may generally buy residential and commercial property in India, but not agricultural land, plantation property, or a farmhouse. This matters in Karnataka because a great deal of peri-urban and coastal land is agricultural until a DC conversion order is in place. Buying what is still agricultural land, or plantation land on the coast or in the malnad belt, can put an NRI buyer outside what FEMA permits. Verification therefore has to confirm not just clean title but that the property is of a category the buyer is allowed to acquire.

Power of attorney for registration

An NRI who cannot travel for registration usually executes a power of attorney in favour of someone in India. For property, that PoA generally needs to be executed before the Indian consulate or notarised abroad and then adjudicated and stamped in Karnataka before it can be used for registration. A PoA that is defective or under-stamped can stall the registration or be challenged later. Getting the PoA right is part of the same exercise as verifying the title.

How an NRI engages remotely

The documents are shared over WhatsApp or email across time zones; the record searches are run in Karnataka; the legal opinion comes back in writing. Where a PoA is needed, the wording and the adjudication route are settled in advance so the attorney in India can complete registration. The buyer does not need to fly down to have the title checked.
