When a parent dies leaving a house to three children, or two siblings jointly inherit a site, the property vests in all of them together. If one wants to give up their share so the others can hold or sell it cleanly, the instrument that does it is a relinquishment deed — in Karnataka, usually drawn as a release deed. Done properly and registered, it settles the share for good. Done loosely, it becomes the document a bank or a future buyer refuses to accept.
What a relinquishment deed is
A relinquishment deed is a registered instrument by which a co-owner or legal heir surrenders their undivided share in a jointly held property in favour of the other co-owners. In Karnataka the same transaction is commonly executed as a release deed under the Karnataka Stamp Act, 1957. The share does not go to the open market — it merges into the holdings of the people who already own the rest of the property.

The essential condition: a relinquishment can only be made in favour of someone who already holds a share — a co-owner or co-heir. You cannot relinquish your share to an outsider. A transfer to a person with no pre-existing interest is a sale or a gift, not a release, and it is stamped accordingly.

Stamp duty on a relinquishment deed in Karnataka
Stamp duty on a release or relinquishment deed under the Karnataka Stamp Act, 1957 turns on two things: whether it is among family members, and whether any consideration is paid.
- Among family members, without consideration — a concessional, broadly fixed duty in the order of a few thousand rupees, rather than a percentage of the property's value
- To a non-family co-owner, or for consideration — stamped closer to a conveyance, calculated on the value of the share being released
Karnataka has also revised its registration fee upward in recent years. Because both the rate and the family concession are periodically amended, confirm the current figure on the Kaveri Online stamp-duty calculator, or with the jurisdictional Sub-Registrar, before you draft — rather than relying on a number from a forum. Under-stamping a release deed only defers the problem to the day a buyer's advocate examines the file.
Registering the deed at the Sub-Registrar's Office
- Draft the deed precisely — identify the property, the exact share being released, every co-owner, and whether it is with or without consideration
- Pay the stamp duty and registration fee through the Kaveri Online portal
- Attend the jurisdictional Sub-Registrar's Office in person — the releasing co-owner, the co-owners receiving the share, and two witnesses
- Carry photo ID and address proof for every party, and the title documents that establish the co-ownership
- Registration is mandatory — an unregistered release of a share in immovable property does not pass that share

Can a registered relinquishment deed be undone?
Not easily. Once registered, a relinquishment is treated as a final settlement of that share. It can be set aside only on limited grounds — fraud, coercion, or that it was never validly executed — and that means a civil suit, not a change of mind. Because it is so hard to reverse, the drafting and the decision matter far more than the fee saved.
