Power of Attorney Registration in Bangalore: Stamp Duty & Process

How to register a power of attorney for property in Bangalore: General vs Special POA, Karnataka stamp duty (Article 41), the Sub-Registrar process, documents and timeline.

An owner moving abroad wants a sibling to manage a flat. A buyer needs a relative to sign at the sub-registrar on a date they cannot attend. A parent wants a child to handle a plot's paperwork. Each of these needs a power of attorney — and a power of attorney is only as good as the way it is drafted, stamped and registered. Get the type or the stamp duty wrong, and the document that was meant to save a trip becomes the thing a later buyer, or a court, refuses to accept.

What registering a power of attorney means in Karnataka

A power of attorney (POA) is a deed by which one person — the principal — authorises another — the agent, or attorney — to act on their behalf. Registering it means executing the deed on stamp paper of the correct value and then presenting it at the jurisdictional Sub-Registrar's Office so it enters the public record. A POA that only deals with limited, non-transfer matters can often run on notarisation alone. The moment a POA touches the transfer of immovable property, registration is a different and stricter question — dealt with below.

General or special power of attorney — get the type right first

A General Power of Attorney (GPA) grants broad authority across many acts; a Special Power of Attorney (SPA) authorises one defined task. For a single property transaction, an SPA that names the specific property and the exact act — 'to present and admit execution of the sale deed for site no. X' — is usually the safer instrument. It hands the agent only the authority the job needs. A GPA covering 'all my affairs' is convenient, but it gives the agent wide latitude to act in ways the principal never pictured. One point holds for both: neither a GPA nor an SPA transfers ownership. The Supreme Court settled in Suraj Lamp (2011) that a 'GPA sale' passes no title. A power of attorney is authority to act on a property — never proof that the holder owns it.

How our property document verification works

Under the Registration (Karnataka Amendment) Act, 2025, a power of attorney that authorises the transfer of immovable property — by sale, gift, exchange or otherwise — must be registered. For these transfer-authorising POAs, notarisation is no longer enough. A POA limited to routine acts, such as collecting rent or appearing before an authority, may not attract compulsory registration, but registering it still gives it a date, a record and far more evidentiary weight if it is ever questioned.

Stamp duty on a power of attorney in Karnataka

Stamp duty on a POA is fixed by Article 41 of the Karnataka Stamp Act, 1957. It turns on two things: who the agent is, and whether the deed authorises a sale or transfer.

  • Family member, without consideration — where the agent is a spouse, child, parent, sibling or other close relative and no money changes hands, the duty is a fixed amount, in the order of ₹500 (Article 41(e))
  • Non-family agent, or a POA authorising sale or transfer to a non-relative — stamped close to a conveyance, in the order of 5% of the property's market (guidance) value (Article 41(g))
  • Special power of attorney for a limited act, such as representation before a court or authority — a nominal fixed duty of a few hundred rupees

These amounts are indicative and are revised by the State from time to time. Confirm the current Article 41 schedule, and the guidance value of the property, before you buy stamp paper or pay duty through the Kaveri Online portal. Under-stamping is not a saving — an under-stamped POA can be impounded and penalised later, usually at the worst moment, when the buyer's advocate is examining the file.

Registration fees and what you pay at the counter

The registration fee is separate from stamp duty. For a family POA it is commonly in the range of a few hundred to about a thousand rupees, plus a small per-page scanning charge. For a POA registered against a specific property, the fee may instead be charged as a percentage of value, subject to a cap. The figures move — ask the Sub-Registrar's Office for the exact fee for your instrument rather than relying on a number from a forum.

The registration process at the Sub-Registrar's Office, step by step

If everyone attends and the papers are in order, registration is usually completed in a single visit.

  • Draft the POA precisely — name the principal and the agent, and spell out each power granted. Vague drafting is where later disputes begin
  • Print it on e-stamp paper of the correct value, or pay the duty through the Kaveri Online portal
  • Attend the jurisdictional Sub-Registrar's Office in person — the principal, the agent and two witnesses
  • Carry originals and photocopies of photo ID and address proof for every party and witness
  • The office captures photographs and biometrics of the parties and verifies identity — the proof-of-life step that helps guard against forged and posthumous POAs
  • Pay the registration fee; the registered deed is returned after scanning, usually within a few days

The live-principal requirement matters here. A POA cannot be validly registered on behalf of a principal who has died, and in practice the Sub-Registrar's biometric verification requires the principal to be alive and identifiable at registration. This is exactly the gap a careful buyer checks when someone offers to sell on an old power of attorney.

Documents required

  • The drafted power of attorney, on stamp paper of the correct value
  • Photo ID and address proof of the principal and the agent — Aadhaar, passport, PAN or voter ID
  • Two witnesses, each with their own photo ID and address proof
  • Passport-size photographs of the parties and the witnesses
  • For a property-specific POA: the title deed, latest khata and the most recent tax-paid receipt for the property concerned

If you are an NRI executing from abroad

An NRI principal often cannot fly in to sign. A POA executed outside India must be signed before an Indian consulate (consularisation) or apostilled under the Hague Convention in the country of execution, and then stamped or adjudicated in Karnataka — under Section 18 of the Indian Stamp Act, within three months of its arrival in India. Mistakes that get a POA rejected — or challenged years later

  • Under-stamping — using the family rate on a POA that actually authorises a non-relative sale, so the deed is later impounded and penalised
  • Powers drafted too broadly, letting the agent do more than the principal ever intended
  • Skipping registration on a transfer-authorising POA executed after the 2025 amendment
  • Leaving a POA live after it has served its purpose — an unrevoked general power of attorney keeps working until it is formally cancelled
  • Treating a power of attorney as proof of ownership when buying — it is authority to act on the property, not title to it
